Felonies and Misdemeanors

As a Former State Prosecutor I have prosecuted numerous misdemeanor and felony charges. Cases ranging from theft, domestic violence, battery, weapons, DUI, suspended license, revoked license, attempted murder and murder.

A DUI can be a misdemeanor if someone is charged with a DUI for the first time. However, with the recent changes in the law, a police officer in connection with the State Attorney's office can upgrade a first time offender to a felony for numerous reasons. These reasons could be any of the following, drivers license is not valid at the time of the stop, not having auto insurance and numerous other reasons. Another example of a misdemeanor is driving on a revoked or suspended driver's license. Again this complaint can be upgraded to a felony.
